Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of dinexp.club and the related features we offer (the "Service"), operated by DineXp from Johannesburg, South Africa ("DineXp", "we", "us"). By using the Service you agree to these Terms. If you do not agree, please stop using it.
Our Privacy Policy explains how we handle your personal information and forms part of these Terms.
2. What DineXp Is
DineXp is a discovery platform. We help you find restaurants, browse their menus, read and write reviews, save places and dishes, and decide where to eat.
We are not a restaurant, a booking agent, a delivery service or a payment processor. We do not take reservations, accept orders or handle money. When you tap a restaurant's reserve, order, WhatsApp, call, website or directions button, you leave DineXp and deal directly with that restaurant or with the third-party platform it uses. Any booking, order, meal or dispute is between you and them.
3. Eligibility and Accounts
You must be at least 18 years old to create an account. You may browse DineXp without one, but you need an account to save places, add cravings, write reviews or create a creator profile.
You sign in with a Google account or an email sign-in link — we do not issue passwords. You are responsible for keeping access to that email or Google account secure, and for activity that happens under your account. Tell us promptly if you think someone else is using it.
You must give accurate information when you register, and keep it current. You may close your account at any time by contacting us.
4. Your Content
"Your Content" means anything you submit to the Service: reviews, ratings, profile details, images, links to your social posts and the display name you use in a game session.
You keep ownership of Your Content. By submitting it, you grant DineXp a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, publish and distribute it in connection with operating and promoting the Service. This licence lasts while the content is on the Service and for a reasonable period afterwards to allow for backups and caches. It ends when you delete the content, except for copies already shared by others or retained as required by law.
You confirm that Your Content is yours to share, that it does not infringe anyone's rights, and that it does not break any law.
We are not obliged to review Your Content before it appears, but we may remove or edit anything that breaches these Terms, and we may decline or reverse creator verification at our discretion.
5. Reviews and Community Standards
Reviews are for honest, first-hand experiences. You agree not to:
- Post a review of a place you have not visited, or a dish you have not had.
- Accept payment or a benefit in exchange for a review without disclosing it.
- Post reviews about yourself, a business you are connected to, or a competitor.
- Post content that is defamatory, harassing, hateful, obscene, discriminatory or threatening.
- Include other people's personal information without their permission.
We may remove reviews that breach these standards, and may restrict accounts that do so repeatedly.
6. Creator Profiles
If you set up a creator profile, the information you enter — username, display name, title, bio, city, specialties, social links and images — is public. Choose what you are comfortable publishing. You are responsible for the accuracy of your profile and for disclosing commercial relationships where the law requires it. Verification, where we grant it, reflects our own checks and is not a warranty of anything.
7. Decide Where To Eat
Our game features are for entertainment. A group session works from a shortlist and a code that anyone with the link can join, so only share a code with people you intend to include. The display name and choices you enter are visible to everyone in that session once results are revealed. Sessions are temporary and are deleted automatically within about a day.
8. Restaurant and Menu Information
Restaurant details, menus, dishes, prices, opening hours, photos and ratings come from venues themselves and from public sources. We work to keep them current, but we cannot guarantee that any of it is accurate, complete or up to date.
Always confirm with the restaurant before you rely on this information — particularly prices, availability, opening hours, and anything relating to allergens, dietary requirements or food safety. Nothing on DineXp is dietary, medical or health advice.
Ratings and rankings on DineXp reflect our own signals and third-party data. They are not an endorsement, guarantee or certification of any venue.
9. Venue Features
Some features — such as digital and PDF menus, QR links and the in-venue display board — are provided for restaurants to use on their own premises. Restaurants are responsible for the content they publish through them, and for keeping it accurate.
10. Acceptable Use
You agree not to:
- Break any applicable law, or use the Service for an unlawful purpose.
- Impersonate DineXp, a restaurant, a creator or anyone else, or misrepresent your affiliation.
- Scrape, crawl, harvest or bulk-download content, or use automated means to access the Service, except for search engines obeying our robots directives.
- Copy, resell or redistribute our content or data as a competing product or dataset.
- Interfere with the Service, probe or test its security, circumvent rate limits or access controls, or introduce malicious code.
- Send spam, chain messages or unsolicited promotional material through the Service.
- Manipulate ratings, reviews, votes or analytics, including by using multiple accounts.
- Exploit or harm minors in any way.
11. Intellectual Property
The Service and everything in it other than Your Content and third-party content — including software, design, text, graphics, the DineXp name and logo — belongs to DineXp or its licensors and is protected by copyright, trade mark and other laws. You get a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. Nothing in these Terms transfers ownership to you.
If you believe content on DineXp infringes your rights, email us with enough detail to identify the content and your claim, and we will investigate.
12. Third-Party Services
The Service links to and embeds third-party content and services, including restaurant websites and reservation, ordering and messaging platforms, maps and directions, and social media posts. We do not control those services, do not endorse them, and are not responsible for their content, practices or terms. Their own terms and privacy policies apply when you use them.
13. Suspension and Termination
You may stop using the Service at any time and ask us to delete your account.
We may suspend or terminate your access, with notice where reasonably possible, if you breach these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive — content licence, intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply.
14. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we do not warrant that it will be uninterrupted, error-free or secure, that information on it is accurate, or that it will meet your requirements. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
We are not responsible for your experience at any restaurant, for a booking or order you place through a third party, or for anything a restaurant, creator or other user does.
15. Limitation of Liability
To the fullest extent the law allows, DineXp and its directors, employees, partners, agents and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or opportunity, arising out of or connected with your use of or inability to use the Service, content obtained through it, the conduct of any third party on it, or unauthorised access to your content.
Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or ZAR 1,000.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2008, for death or personal injury caused by negligence, or for fraud.
16. Indemnity
You agree to indemnify DineXp against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or Your Content infringing someone else's rights.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. If we cannot resolve a dispute informally, you agree to the non-exclusive jurisdiction of the South African courts. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence.
If a provision of these Terms is found invalid or unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it.
18. Changes to These Terms
We may update these Terms as the Service changes. We will post the revised version here and update the date at the top. If a change is material, we will give reasonable notice — normally at least 30 days — before it takes effect. Continuing to use the Service after that means you accept the new Terms; if you do not, please stop using it.
